These terms of use are entered into by and between You and Dogon Chargers LLC (“Dogon,” “we,” or “us”). The following terms and conditions, together with any documents they expressly incorporate by reference (collectively, “Terms of Use”), govern your access to and use of dogonchargers.net (the “Website”) and the Dogon Charging application (the “App,” and, collectively with the Website, the “Services”), including any content, functionality and offerings provided on or through the Services.

PLEASE READ THE TERMS OF USE CAREFULLY BEFORE YOU START TO USE THE SERVICES.

By using the Services or clicking to accept or agree to the Terms of Use when this option is made available to you, you accept and agree to be bound and abide by these Terms of Use and our Privacy Policy, incorporated herein by reference. You must not access or use the Services if you do not want to agree to these Terms of Use or the Privacy Policy.

CHANGES TO THE TERMS OF USE

We may revise and update these Terms of Use from time to time at our sole discretion. All changes are effective immediately upon publication and applies to all use of the Services.

Your continued use of the Services following the posting of revised Terms of Use means that you accept and agree to the changes. You are expected to check this page from time to time so you are aware of any changes, as they are binding on you.

The Dogon name, the terms “dogonchargers.net,” “Dogon Network,” “Dogon,” the Dogon logos, and all related names, logos, product and service names, designs, and slogans are trademarks and the intellectual property of Dogon or its affiliates or licensors. You must not use such marks without our prior written permission. All other names, logos, product and service names, designs, and slogans contained in the Services are the trademarks of their respective owners.

Some of the information available through the Services may contain projections or other forward-looking statements regarding future events or our future financial performance. We wish to caution you that these statements are only predictions and that actual events or results may differ materially.

PRODUCT AND SERVICE AVAILABILITY

The owner of the Services is based in the United States. We provide the Services for use only by persons located in the United States. We make no claims that the Services or any of its content is accessible or appropriate outside of the United States. Access to the Services may not be legal by certain persons or in certain countries. If you access the Services from outside the United States, you do so on your own initiative and are responsible for compliance with local laws.

Access to and use of password-protected and/or secure areas of the Services is restricted to authorized users only. Unauthorized individuals attempting to access these areas of our websites may be subject to prosecution.

Mention of non-Dogon products or services is for information purposes only and constitutes neither an endorsement nor a recommendation. You are responsible for implementing sufficient procedures and checkpoints to satisfy your particular requirements for anti-virus protection and accuracy of data input and output, and for maintaining a means external to our site for any reconstruction of any lost data.

GOVERNING LAW AND JURISDICTION

All matters relating to the Services and these Terms of Use, and any dispute or claim arising therefrom or related thereto (in each case, including non-contractual disputes or claims), shall be governed by and construed in accordance with the internal laws of the State of Georgia without giving effect to any choice or conflict of law provision or rule (whether of the State of Georgia or any other jurisdiction). Any legal suit, action or proceeding arising out of, or related to, these Terms of Use or the Services shall be instituted exclusively in the federal courts of the United States or the courts of the State of Georgia, although we retain the right to bring any suit, action or proceeding against you for breach of these Terms of Use in your country of residence or any other relevant country. You waive any and all objections to the exercise of jurisdiction over you by such courts and to venue in such courts.

ARBITRATION

In Dogon’s sole discretion, it may require you to submit any disputes arising from these Terms of Use or use of the Services, including disputes arising from or concerning their interpretation, violation, invalidity, non-performance, or termination, to final and binding arbitration under the Rules of Arbitration of the American Arbitration Association applying Georgia law.

LIMITATION ON TIME TO FILE CLAIMS

ANY CAUSE OF ACTION OR CLAIM YOU MAY HAVE ARISING OUT OF OR RELATING TO THESE TERMS OF USE OR THE SERVICES MUST BE COMMENCED WITHIN ONE (1) YEAR AFTER THE CAUSE OF ACTION ACCRUES; OTHERWISE, SUCH CAUSE OF ACTION OR CLAIM IS PERMANENTLY BARRED.

WAIVER AND SEVERABILITY

No waiver by Dogon of any term or condition set forth in these Terms of Use shall be deemed a further or continuing waiver of such term or condition or a waiver of any other term or condition, and any failure of Dogon to assert a right or provision under these Terms of Use shall not constitute a waiver of such right or provision. If any provision of these Terms of Use is held by a court or other tribunal of competent jurisdiction to be invalid, illegal, or unenforceable for any reason, such provision shall be eliminated or limited to the minimum extent such that the remaining provisions of the Terms of Use will continue in full force and effect.

ENTIRE AGREEMENT

The Terms of Use and our Privacy Policy, constitute the sole and entire agreement between you and Dogon with respect to the Services and supersedes all prior and contemporaneous understandings, agreements, representations, and warranties, both written and oral, with respect to the Services.

Privacy Policy – Dogon Chargers

Dogon Chargers, LLC (“Dogon,” “we,” “our,” or “us”) provides this privacy policy (the “Policy”) to inform you how we process your information, whether you are a visitor to our website located at dogonchargers,net (the “Website) or the Dogon Charger application (the “App”), a purchaser of our electric vehicle charging stations, or a user of electric vehicle charging stations on the Dogon Network. The “Dogon Network” refers to Dogon’s open-platform network of electric vehicle charging stations and vehicle charging applications including the App.

Except as explicitly provided herein, this Policy applies to your use of Website, App, and to any service offered by Dogon that includes a link to this Policy, including your Dogon account (if you have registered or are registering your account) and the Dogon Charging radio-frequency identification cards (the “RFID cards”) (each of these services and applications are collectively defined as the “Service”).

Please read this Policy carefully to understand how we handle your information. By using or otherwise accessing the Service, you agree to this Policy. If you do not agree to this Policy, please do not access or use the Service.

State and international law requires us to disclose information regarding the categories of personal information that we have or will collect about certain consumers, the categories of sources from which the information was collected, the business or commercial purposes (as those terms are defined by applicable law) for which the information was collected, and the categories of parties with whom we share personal information.

Other uses about which we notify you

Examples of these types of uses are identified below. We may also use the categories of personal information for compliance with applicable laws and regulations, and we may combine the information we collect (“aggregate”) or remove pieces of information (“de-identify”) to limit or prevent identification of any particular user or device.

Online Analytics and Tailored Advertising:

Analytics. We may use third-party analytics services such as Google Analytics. These service providers use analytics technologies to help us analyze how users use the Service, including analyzing your Website and App use, compiling reports on Website and App activity, and providing us with other services relating to Website and App activity and internet usage. We may also use Google Analytics or similar services for certain purposes related to advertising, as described in the following section. To prevent Google Analytics from using your analytics information, you may install the Google Analytics Opt-Out Browser Add-on for your current web browser.

Tailored Advertising. We and our third-party service providers may use device identifiers and other automated technologies (including cookie identifiers on our Website and in our App), along with other collected information, to deliver content or tailor ads when you use our Service or other devices, apps, or websites. These ads may be based, for instance, on the types of websites that you visit over time, the types of apps you have on your device, or de-identified information about you and your likely interests, based on your activities apart from our Service. Security Measures

We have implemented administrative, physical, and technical security measures to protect your information under our control. While we take precautions against possible security breaches to the Service, no website or Internet transmission is completely secure, and we cannot guarantee that unauthorized access, hacking, data loss, or other breaches will never occur. We cannot guarantee the security of your information while it is being transmitted to our Website or App or stored in our systems; any transmission is at your own risk.

You should take steps to keep your information safe (including your password) and log out of your account after use. Where we have provided you, or you have chosen, a password that enables you to access certain parts of our Website, App, or a Dogon RFID Card to access charging stations, you are responsible for keeping your password and the Dogon Charging RFID Card confidential. You must not share these with anyone or store them in a way that may allow a third party to access them. If such happens, you agree to report it immediately to support@dogonchargers.com. Dogon cannot be held responsible for your failure to keep your password or the Dogon Charging RFID Card secure. You should update your password periodically to help reduce the risk of unauthorized access to your account with us. When you do, you should strengthen your password with the combination of uppercase and lowercase letters, numbers, punctuation, and other symbols.

Your Choices

You may modify certain of the information we maintain about you by accessing your account. You may unsubscribe from marketing communications from us by following the directions in those communications. Please note that, if you opt out of, and unsubscribe from, receiving marketing communications, we may still send you certain communications relating to your use of the Service (e.g., service announcements, notices about new features, or information on the Service, administrative messages, and communications regarding your account).

Local laws may also grant you additional rights. For example, some state law allows consumers to opt out of the sale of “personally identifiable information” for monetary consideration to a person for that person to license or sell such information to additional persons. “Personally identifiable information” includes first and last name, address, email address, phone number, Social Security Number, or an identifier that allows a specific person to be contacted either physically or online. We do not engage in such activity; however, if you believe any such law is applicable to you, and you have purchased or leased goods or services from us, you may submit a request to opt out of any potential future sales under the applicable law by emailing support@dogonchargers.com. Please note we will take reasonable steps to verify your identity and the authenticity of the request. Once verified, we will maintain your request in the event our practices change.

Supplemental Privacy Notice for California Residents:

This Supplemental Privacy Notice supplements the information in our Privacy Policy, and except as provided herein, applies solely to California residents. It applies to personal information we collect on or through the Service and other means (such as information collected offline, in person, and over the telephone). It does not apply to personal information we collect from our employees and job applicants in their capacity as employees and job applicants. It also does not apply to personal information we collect from employees, owners, directors, officers, or contractors of businesses in the course of our provision or receipt of business-related services.

Rights

If you are a California resident, you may have certain rights. California law may permit you to request that we: (i) provide you with the categories of personal information we have collected or disclosed about you in the last twelve months; the categories of sources of such information; the business or commercial purpose for collecting or selling your personal information; and the categories of third parties with whom we shared personal information; (ii) provide you access to and/or a copy of certain information we hold about you; and (iii) delete certain information we have about you.

You may have the right to receive information about the financial incentives that we offer to you, if any. You also have the right not to be discriminated against (as provided for in applicable law) for exercising certain of your rights. Certain information may be exempt from such requests under applicable law. We need certain types of information so that we can provide the Service to you. If you ask us to delete it, you may no longer be able to access or use the Service.

If you would like to exercise any of these rights, please submit a request at support@dogonchargers.com. You will be required to verify your identity before we fulfill your request. To do so, you will need to provide the information identified in the webform or as otherwise directed by us. You can also designate an authorized agent to make a request on your behalf. To do so, you must provide us with written authorization or a power of attorney signed by you for the agent to act on your behalf. You will still need to verify your identity directly with us.

California residents may opt out of the “sale” of their personal information. We do not “sell” your personal information as we understand that term to be defined by the California Consumer Privacy Act and its implementing regulations, and we have not sold your personal information in the past twelve months.

California Do-Not-Track

We do not respond to browser-initiated Do Not Track signals, as the Internet industry is currently still working on Do Not Track standards, implementations, and solutions. Children’s Privacy:

The Website, App, and Service are intended for persons licensed to drive. In the United States, this typically means individuals over the age of 16. We do not knowingly collect any information from anyone under 16 years of age. If you are less than 16 years of age, we request that you do not submit information to us. If we become aware that we have inadvertently collected “personal information” (as defined by the United States Children’s Online Privacy Protection Act) from children under the age of 13 without parental consent, we will take reasonable steps to delete it as soon as possible as required by applicable law.

Changes to Our Privacy Policy:

We may change this Policy to reflect changes in the law, our information practices, or the Service features. At the top of our Policy, we will indicate the date of the most recent update. Here's a step-by-step guide on how to delete your user account from the Dogon Charger app

Step 1 - Tap on the "Profile" icon or your name to access your profile page.

Step 2 - On your profile page, locate and tap on "Account Settings."

Step 3 - You will find the "Delete Account" option in the list.

Step 4 - The app will ask you to confirm your decision to delete your account. It may also provide information about the consequences of deleting your account, such as losing access to your charging history.
